Air America and its former afternoon talkshow host aren't liable for comments Rhodes made live on her radio show, when she criticized CACI International over its work at the Abu Ghraib prison in Iraq. A three-judge panel of the federal appeals court in Richmond said unanimously that the comments are protected by the First Amendment, and weren't made with actual malice or reckless disregard for the truth. The Arlington, VA. Company sued for $11 million. Originally a federal judge in Alexandria dismissed the lawsuit, and this decision by the appeals court upholds that decision.
